Professional Titles/Professional rules
The professional title "Rechtsanwalt" or "Rechtsanwältin" ["Lawyer"] (Federal Republic of Germany) was initially accorded to members of the firm on the basis of legal standards of the Federal Republic of Germany after they passed the 2nd state examination in law and completed a separate approval procedure by the relevant Department of Justice through the president of the Higher Regional Court with jurisdiction over its head office and on the basis of the legal position of the Chambers of Lawyers for the respective area, as amended in 08.09.1998 (see Chambers of Lawyers/supervisory authorities above). They are subject to the professional rules of the Federal Lawyer Order (BRAO), the Lawyer Remuneration Act (RVG), the Professional Rules of the Federal Chamber of Lawyers (BORA), the Specialist Lawyer Order of the Federal Chamber of Lawyers (FAO) and the Professional Ethics for Lawyers in the European Community (CCBE - Council of Bars and Law Societies of Europe).
The professional rules for licensing as an "EU lawyer based in Germany" are laid down in Art. 1, Part 2, Section 1(2)(1) of the Act implementing European Community guidelines on the legal profession of 03.09.2000 and in the Act on the activities of European lawyers in Germany.
The professional title "Notar" or "Notarin" ["Notary"] has been given to members of the firm in the respective Federal State in which the notary is employed on the basis of professional rules that are standard German (Federal Notary Order, BNotO). They are subject to the provisions of the Certification Act (BeurkG) and the law on costs in cases of voluntary jurisdiction (Cost Order, "KostO"). The corresponding professional rules are given under the heading "Professional rules" on the Federal Chamber of Notaries website.
Authorized Representatives
